Notice of Privacy Practices – SWFL Health and Hydration

This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully. SWFL Health and Hydration is required by law to maintain the privacy of your protected health information (PHI), to notify you of our legal duties and privacy practices, and to abide by the terms of this notice.

1. Who We Are

SWFL Health and Hydration, LLC operates mobile and in-office IV therapy and wellness services throughout Southwest Florida. Our services are supervised by a Board Certified Medical Doctor and administered by licensed Registered Nurses.

This notice applies to all services provided by SWFL Health and Hydration, LLC, including mobile appointments, in-office visits at 7990 Summerlin Lakes Dr., Suite 100, Fort Myers, FL 33907, and any telehealth or phone consultations.

2. How We Use and Disclose Your Health Information

We may use and share your protected health information (PHI) in the following ways:

Treatment

We use your PHI to provide, coordinate, and manage your IV therapy and wellness services. For example, your nurse may share your health screening information with our Medical Director to determine which treatments are appropriate for you.

Physician Notification

Consistent with Florida's guidelines for IV hydration providers, we may notify your designated primary care physician or specialist that you have received an IV therapy treatment, including a summary of the treatment administered.

Healthcare Operations

We may use your PHI for internal business operations, including quality improvement, training, compliance reviews, and audits. This does not include selling your information.

Payment

We may use your PHI to process payment for services, including communications with payment processors. Appointment booking is handled through Square (squareup.com), a third-party platform subject to its own privacy policy.

As Required by Law

We will disclose your PHI when required to do so by federal, state, or local law — including public health reporting requirements and law enforcement requests as permitted by HIPAA.

Emergency Situations

We may share your PHI with emergency responders or treating facilities if you experience a medical emergency during or after your treatment.

3. Uses and Disclosures That Require Your Authorization

We will not use or share your PHI for the following purposes without your written authorization:

Marketing communications or promotion of products/services
Sale of your health information to any third party
Disclosure of psychotherapy notes (if applicable)
Any other use not described in this notice

You may revoke any authorization you have given us at any time in writing. Revocation will not affect uses or disclosures already made in reliance on the prior authorization.

4. Your Privacy Rights

You have the following rights regarding your health information:

Right to Access Your Records

You have the right to inspect and receive a copy of your PHI. We will respond to your request within 30 days. A reasonable fee may apply for copies.

Right to Request Corrections

If you believe your health information is incorrect or incomplete, you may request that we amend it. We may deny the request if we determine the information is accurate.

Right to Restrict Use or Disclosure

You may request restrictions on how we use or share your PHI. We are not required to agree to all requests, but will comply where feasible.

Right to Confidential Communications

You may request that we communicate with you in a specific way or at a specific location (e.g., call your cell phone rather than your home number). We will accommodate reasonable requests.

Right to an Accounting of Disclosures

You may request a list of certain disclosures we have made of your PHI over the past six years, excluding disclosures for treatment, payment, and operations.

Right to a Copy of This Notice

You may request a paper copy of this Notice at any time, even if you have agreed to receive it electronically.

5. Our Duties

SWFL Health and Hydration is required by law to:

Maintain the privacy and security of your PHI
Provide you with this Notice of Privacy Practices
Follow the terms of the notice currently in effect
Notify you if there is a breach of your unsecured PHI

We reserve the right to change this notice. If we make material changes, we will post the updated notice on our website and have it available at our office. The effective date will be updated accordingly.

6. Florida Information Protection Act

In addition to HIPAA, we comply with the Florida Information Protection Act of 2014 (FIPA), which governs the handling and security of personal information for Florida residents. In the event of a data breach involving your personal information, we will notify you in accordance with FIPA timelines.

7. How to File a Complaint

If you believe your privacy rights have been violated, you have the right to file a complaint with:

You will not be penalized or retaliated against for filing a complaint.
